Torrance Motorcycle Accident Lawyer
When people are riding motorcycles, other than maybe a helmet, they're virtually unprotected. There is no steel body or frame surrounding them to protect them from an impact, and there aren't any air bags. There aren't any seat restraint systems to keep them from being thrown off of the bike either. When there is a crash involving another vehicle the
only guarantee is that the ground will eventually stop them. Before that, they might get hit by a second motorist or crash into a stationary object.
Jeffrey L. Molchan is the premier Torrance motorcycle accident lawyer. At the Molchan Law Firm, we have extensive experience in the representation of motorcyclists who have suffered serious injuries. The Hurt Report
This report was commissioned by the National Highway Transportation Safety Administration (NHTSA). It contracted with the University of California Traffic Safety Center. The study was headed by Professor H.H. Hurt. The purpose of the study was to identify motorcycle crash cause factors and countermeasures. The Hurt Report was published in 1981, and it remains the most comprehensive and authoritative motorcycle accident study to date. Professor Hurt and his investigators were all motorcyclists. They performed exhaustive investigations of 900 motorcycle accidents throughout Los Angeles and studied 3,600 police reports. Here are some of the Hurt Report findings:
- About 75 percent of all motorcycle accidents involved a collision with another vehicle-- that other vehicle was usually a passenger car.
- About 25 percent of all motorcycle accidents were single vehicle accidents involving only the motorcyclist and rider error.
- In cases of multiple vehicle accidents, the driver of the other vehicle violated the motorcyclist's right-of-way about 66 percent of the time.
- In multiple vehicle accidents, the failure of the motorist to detect motorcycles in traffic was a major cause of motorcycle accidents. Drivers of other vehicles either did not see the motorcycle on the roadway, or didn't see it until it was too late.
The most frequent failure to yield scenario is an automobile making a left turn in front of an oncoming motorcycle. These accidents usually occur in intersections.
- In nearly half of such crashes, the motorist's view was compromised by glare or interfered with by other vehicles.
- The median speed before the crash was 29.8 mph. The median speed at the time of impact was 21.5 mph.
- The motorcyclist was ordinarily allowed less than two seconds in which to avoid an accident.
Of course, the severity or rider injuries increased with speed and alcohol involvement.
- About 98 percent of all motorcyclists who were involved in an accident with another vehicle suffered injuries.
- Half of all such injuries were to the nerve, muscle and bones or both of the feet, ankles, lower legs, knees and upper thighs.
- Most of the deadly injuries suffered by motorcyclists were to the chest and head.
Other Common Injuries
Aside from the injuries noted in the Hurt Report, the most common injury suffered in motorcycle accident is road rash, which consists of cuts and abrasions from sliding on pavement. Road rash must be taken seriously. Infection can easily set in from dirt and other contaminants on the road. Here are some other common injuries that you're going to need the best motorcycle accident attorney in Torrance for:
Fractures: One or more fractures might require one or more surgeries. Even with surgical intervention, fractures can result in nerve damage, disability and disfigurement.
Organ Damage: Vital organs like the heart, pancreas, liver and kidneys can be damaged from the blunt force trauma of a motorcycle crash. Surgery might be required to save a motorcyclist's life.
Amputations: These might be traumatic amputations from the crash itself or medically necessary amputations as a result of the severity of the damage to a limb.
Spinal Cord Damage: Even a bruised spinal cord is going to require rehabilitation. If the cord is partially torn, it will render the victim a paraplegic. If it's completely torn, the victim will become a quadriplegic. Spinal cord tears cannot be repaired.
Traumatic Brain Injuries: Brain bruising or bleeding can change a person both mentally and physically for the rest of his or her life. Some victims will require daily care.
Common Causes of Motorcycle Crashes
There is no question that single vehicle motorcycle crashes happen every day. Those might be caused by rider error, defectively dangerous road conditions like uneven pavement or rocks and gravel on the roadway. Other causes can include aggressive drivers who follow a motorcyclist too closely, drivers who weave in and out of lanes and drivers who ignore red lights and stop signs. Sometimes the accident is caused by dangerously defective parts in a motorcycle itself.
Bias Against Injured Riders
Insurance companies want victims of motorcycle accidents to be perceived in court as careless risk takers. Motorcycle accident attorneys Torrance want to paint a different picture from the onset, which involves meticulous investigation of the facts and circumstances surrounding a motorcycle accident that leaves no stone unturned. You can overcome bias and prejudice against motorcyclists by retaining the best motorcycle accident attorney in Torrance.
Don't Give a Statement
Don't be surprised if a representative from the opposing insurance company calls you and asks you to take your recorded statement of your version of the circumstances surrounding your accident. Politely refuse to give any type of statement. California law doesn't require you to give any type of a statement without an attorney being present on your behalf. That opposing insurance company is only going to try to use your own words against you sometime in the future in efforts to attack your credibility.
Rather than giving that statement, contact our Torrance motorcycle accident lawyer to arrange for a free confidential consultation and case evaluation. We're going to listen to you carefully and answer your questions. After that, we can talk about all of your legal options. Make that call as soon as you are physically capable of doing so, or have a family member make it for you. If we're retained to represent you, no legal fees are even due unless we obtain a settlement or verdict on your behalf.
